One thing I must think be allowed;

I think however that when we should point out to him that if the public servant on his final retirement he again draws emoluments from Hongkong Funds, whether of his final Hong Kong Salary or Pension, he may elect to contribute to the Fund while abroad, according to the usual Rule, there would be deduction in the Colony before any payment is made to himself. We should tell him that the C.A. have been instructed to receive from him the payable quarterly with the equivalent of $160 per annum from 30th July 1897, that being the amount of his final contribution to the Pension Fund in Hongkong, - as above.

As a matter of common-sense, I entirely agree with the above. Ch. 6 W Johnson, but I am rather doubtful whether it is quite justified by the terms of S 3 of 1897. Weil distinct says that a person who leaves the Colony "may continue to contribute .... at the same rate and subject to the same forms as if he had continued in the service of the Colony". This is the first case of the kind, & others will be careful to note what we do. Perhaps the Crown would look at this as the safer course.

If some alteration were made, and I think in some cases it would be wise to tolerate the above dispensation beyond distinction.

Certainly, Mr Wingfield, I think that we should bridge the contribute at the same rate on the same terms only if he had continued in the service of the Colony & that this means that the actual amount which would have been deducted if he had continued in the Government service must be paid by him now. I see no objection to this except for the trouble to the Crown Agent in calculating and verifying the correctness of the calculation at each payment - but there are not many persons who keep up their subscription to the Fund.

I think the Crown contributions, of course, cease when a person leaves the service of the Colony. This is a Colonial matter whether they continue or not. The Colonial Govt should hand over to the Crown the amount due.

But we may note that the case of Controbutors who are in receipt of salary or pension is different, as the 4 per cent is deducted in the Colony from the salary or pension.
